Placing on the market

Placing on the market means the first making available of a battery on the Union market, while making available means any supply for distribution or use in the course of a commercial activity, whether for payment or free of charge. The distinction matters because most obligations under Regulation (EU) 2023/1542 — including conformity assessment, the declaration of conformity, and the battery passport from 18 February 2027 — attach at the moment a battery is placed on the market or put into service.
