Market surveillance authority

A market surveillance authority is a national authority responsible for monitoring that batteries placed on the market comply with Regulation (EU) 2023/1542 and for taking enforcement action when they do not. Under the access tiers of Annex XIII, market surveillance authorities and the Commission can access the most detailed battery passport data, beyond what is available to the public or to persons with a legitimate interest. These authorities operate within the broader EU market surveillance framework established by Regulation (EU) 2019/1020.
